1. Provider and scope

These General Terms and Conditions and Terms of Use apply to the use of the platform schwimmtrainer.at, für kostenlose, kostenpflichtige und zeitlich befristete Geschenkfreischaltungen sowie für Käufe von Waren und einzeln angebotenen digitalen Inhalten im Online-Shop.

2. Purpose of the platform

schwimmtrainer.at ist eine webbasierte Plattform rund um Schwimmen. Sie ermöglicht insbesondere die Registrierung und Präsentation von Übungsleitern, staatlich geprüften Instruktoren, Schwimmlehrern, staatlich geprüften Schwimmtrainern, Sportwissenschaftlern, Schwimmvereinen, Schwimmschulen, Schwimmverbänden und Organisationen sowie den Zugang zu Fachinhalten und – je nach Abonnement – zusätzlichen Plattformfunktionen.

schwimmtrainer.at is not an employer, recruitment agency or contracting party to services arranged between registered users or with third parties. Any such contract is concluded solely between the persons or organisations involved.

The two product areas: PerformanceHub and PerformanceLab

schwimmtrainer.at operates two complementary product areas within a shared platform. PerformanceHub provides public profiles, discoverability, networking and the presentation of coaches, courses, training camps and events. PerformanceLab provides, subject to the applicable Gold access rights, professional athlete and group management, competition and training planning, performance management, testing, planned-versus-actual analysis and PDF documentation. Our ecosystem explains this interaction in plain language.

Both product areas complement each other but are not contractually dependent upon each other. Available features, public visibility and permissions are determined by the selected subscription, the published product description and these terms. Use of one area does not automatically activate another membership, publish private records or make the operator a party to contracts between users. The public ecosystem description is informative and does not independently extend the agreed service scope.

PerformanceHub organisation network

Registered federations and organisations may record and administer self-reported networks of clubs, federations, swimming schools and other organisations, with business contact details, using their existing profile rights. Profiles may link to existing directory entries multiple times or enter personal associations which do not create a generally selectable organisation. A claimed network entry may only be transferred to the organisation’s own registered profile after the original creator has approved the request. Self-reported relationships do not establish official affiliation, employment or endorsement. Users must enter accurate information, respect third-party rights and remove or correct inaccurate claims. Published contact details must be intended for public business use.

3. User account, registration and account deletion

Registration with a valid email address is required for account functions. The email address is verified by a one-time code. Users must keep their details accurate and up to date and protect their email account, password, authenticator and recovery codes against unauthorised access.

Für reine Shopkäufe ist keine Plattformregistrierung erforderlich. Beim Gast-Checkout kann freiwillig ein kostenloses Kundenkonto gewählt werden. Dieses dient ausschließlich dem abgesicherten Zugang zur persönlichen Bestellübersicht und erzeugt weder ein öffentliches Profil noch eine kostenpflichtiges Abonnement. Ein solches Kundenkonto kann später durch eine reguläre Registrierung mit derselben E-Mail-Adresse zu einem Plattformkonto mit Profil erweitert werden.

In the shop customer account, customers can manage the default customer details used for future orders. For record-keeping and accounting purposes, changes to these details do not alter orders already completed or invoices already issued.

As a general rule, each person or organisation should maintain only one profile that can be clearly attributed to them, unless separate profiles are required for legally or organisationally distinct services.

The account holder can delete their user account and associated profile through “My account”. The public profile and directly associated profile content are removed. An active paid subscription is terminated immediately before account deletion is completed so that no further automatic renewal occurs. Account deletion must be distinguished from merely cancelling a subscription and from exercising a statutory right of withdrawal.

Contract, payment, consent and legal records may continue to be stored to the extent necessary despite account deletion where statutory retention obligations apply or the data are required for the establishment, exercise or defence of legal claims. Further details are set out in the Privacy Notice.

Temporary account suspension, review and reinstatement

The operator may temporarily suspend any user account (including trainers, organisations, shop users and athletes) where there is a documented, legitimate concern about safety, misuse, unauthorised access or breaches of platform rules. The measure is not an automatic termination or deletion: sign-in and existing sessions are blocked, while records remain stored during the review. The operator records the reason, responsible administrator and decision history. Affected users may submit their view and request a review through the contact address published on the platform, subject to applicable legal rights.

Following review, the operator may reinstate the account, continue a justified restriction or decide on a separate termination/deletion in accordance with applicable law and these terms. Suspension alone does not cancel or refund a paid subscription; continuing charges, contractual rights, cancellation and refund issues must be assessed separately and transparently. Statutory data protection rights remain exercisable during suspension.

Zusatzbedingungen zum Athleten- und Erziehungsberechtigtenportal

The athlete portal provides an invitation-only, free, read-only view of selected personal performance and diagnostic data already stored by an authorised coach in the Gold · Performancelab. Only the invited person may activate the link for their own records. There is no athlete Gold subscription requirement. The coach remains responsible for the underlying training records and their lawful collection. Sharing access does not transfer ownership of the underlying records or grant editing rights.

For this optional portal access the invited person must expressly confirm being at least 18 years old, accept these terms, acknowledge the privacy notice and separately request personal access to their records. Invitation links expire after seven days and activation requires a six-digit one-time code sent to the invited email address. Subsequent sign-ins require a password and a time-based authenticator code, following account security setup. An email code verifies mailbox control but does not independently verify legal identity or age; false age claims and activation of another person’s invitation are prohibited. An existing date of birth indicating a minor blocks activation.

The coach or the athlete may revoke access at any time. Revocation ends future portal access but does not automatically erase the independent coach-held records. Requests for correction, erasure and complete GDPR access remain available through the controller or platform contact. The 18+ requirement is a voluntary product restriction, not a claim that GDPR consent begins at age 18 throughout the EU; European child-protection initiatives are subject to their respective legal entry-into-force and scope.

The direct athlete account remains limited to people aged 18 or over. For a recorded minor, the coach can instead invite an adult parent or legal guardian after personally checking and documenting their authority. A guardian receives read-only access strictly to this child’s coach records and cannot create or change targets or measurements. No minor receives an independent login through this procedure. Both sides may revoke access; a change in the child’s age or loss of authority requires reassessment. Email codes establish mailbox control only, not legal guardianship. The coach is responsible for verifying parental authority and appropriate GDPR Article 6 and, where applicable, Article 9 grounds before inviting a guardian.

Adult athletes may enter their own private motivational target corridors in a separate user-owned data store. They do not overwrite coach targets, benchmarks, records or reports. The coach cannot edit these private targets. Revoked access ends viewing, subject to applicable erasure, retention and data-subject rights. When a coach changes an athlete contact address, linked access may be withdrawn and an automatically generated, otherwise unused portal-only account deactivated; other accounts, orders and rights are not erased automatically.

4. Profile types, quality standard and qualification evidence

The platform distinguishes the following profile types: swimming instructor, state-certified instructor (BSPA), swimming teacher (ÖWR), state-certified swimming coach (BSPA), sport scientist, swimming club, swimming school, swimming federation and organisation.

Users may state qualifications, titles, federation affiliations or other credentials only if they are genuinely entitled to use them. For the personal profile types swimming instructor, state-certified instructor (BSPA), swimming teacher (ÖWR), state-certified swimming coach (BSPA) and sport scientist, suitable evidence of qualification must be submitted during registration.

The evidence must correspond to the selected profile type. Approval is subject to the following verification criteria, which form part of schwimmtrainer.at’s quality standard:

• Swimming instructor: Evidence of completed swimming-specific instructor training provided by an Austrian umbrella or specialist sports federation within the nationally coordinated instructor system. Instructor training is the first level of the Austrian sports education structure and is offered by umbrella and specialist federations. For swimming, evidence from the Austrian Swimming Federation (OSV), or from a regional swimming federation acting in coordination with the OSV, is taken into account in particular. Confirmation of the general basic module alone, without a swimming-specific training component, is not sufficient for this profile type.
• State-certified instructor – swimming specialisation: Certificate or proof of completion from an Austrian Federal Sports Academy (BSPA) for state-certified sports instructor training with a focus on swimming.
• Swimming teacher (ÖWR): Training evidence from the Austrian Water Rescue Service (ÖWR) from the swimming-teacher qualification level upwards; higher ÖWR teaching qualifications such as lifesaving-swimming instructor may also be accepted.
• State-certified swimming coach: Certificate or proof of completion from an Austrian Federal Sports Academy (BSPA) for state-certified coach training with a focus on swimming.
• Sport scientist: University degree in a relevant sport-science programme from a recognised university.

These criteria form schwimmtrainer.at’s own quality and approval standard. They do not amount to official recognition, formal recognition of a foreign qualification (nostrification) or professional authorisation. Private course, coaching or continuing-professional-development certificates do not create an entitlement to approval of a profile type for which the criteria above require a federation, BSPA, ÖWR or university qualification.

Submission alone allows checkout for a paid plan while review is still pending. However, a personal profile is made public only after a successful manual review. schwimmtrainer.at may then label the profile “Qualification verified”. This label confirms only that suitable evidence was submitted and reviewed for the stated profile type. It does not replace official recognition, current professional or federation authorisation, or any guarantee of the person’s professional quality or current activity.

Contractual refund commitment if qualification review is negative: Schließt ein Nutzer nach Einreichung eines Nachweises eine kostenpflichtige Bronze-, Silber- oder Gold-Abonnement ab und wird genau dieser Nachweis anschließend als für den gewählten personenbezogenen Profiltyp nicht geeignet abgelehnt, wird das betroffene Abonnement beendet. Bereits für dieses nach der Einreichung abgeschlossene Abonnement erfolgreich eingezogene Zahlungen werden vollständig über Stripe an das ursprüngliche Zahlungsmittel zurückerstattet. Für nicht erfolgreich belastete Beträge besteht naturgemäß kein Erstattungsbetrag. Die technische Gutschrift kann je nach Zahlungsart und Bank mehrere Tage benötigen. Diese zusätzliche vertragliche Zusage beschränkt gesetzliche Rücktritts-, Gewährleistungs- oder sonstige Verbraucherrechte nicht.

After rejection, new suitable evidence must be submitted before another paid purchase for that personal profile type. If the profile type is later changed, an existing approval for the previous profile type ceases to apply; new evidence may be required for the new profile type.

5. User content

Users remain responsible for texts, images, logos, offers, contact details, qualification information and other content they provide. Only content for which the necessary publication rights exist may be uploaded.

By uploading content, the user grants schwimmtrainer.at, for as long as that content is published, a non-exclusive, worldwide licence limited to operating the platform, to the extent technically necessary to store, display, resize, transmit and present the content in the intended areas of the platform.

Prohibited content and conduct include, in particular, unlawful, misleading, discriminatory, insulting, violence-glorifying, pornographic, rights-infringing, fraudulent or obviously irrelevant content, as well as automated extraction, scraping, abusive bulk use or circumvention of technical protection measures.

5a. Location information and Discovery Map

Publicly released location information for profiles, offers, courses and events may additionally be displayed on an interactive map under “Find”. The map position is derived automatically from the published location information and may, for technical reasons, differ slightly from the actual location. Users are responsible for publishing only location and event information that they are entitled to publish.

For profiles, only town/city, region and country are used for the map position for privacy reasons. Offers and events may be positioned more precisely using their expressly published location/venue text. The map is provided for orientation only and does not constitute a guarantee of the exact geographical location, availability or delivery of an offer.

6. Abonnements

Standard ist dauerhaft kostenlos. Die kostenpflichtigen Abonnements Bronze, Silver and Gold are offered monthly or annually.

Der jeweilige Leistungsumfang ergibt sich aus der zum Zeitpunkt der Bestellung auf der Abonnementübersicht dargestellten Leistungsbeschreibung. Gold, Silber oder Bronze bezeichnen ausschließlich den gebuchten Funktionsumfang der Plattform und stellen keine Aussage über die fachliche Qualifikation eines Nutzers dar.

Eine Abonnement begründet keinen Anspruch auf eine bestimmte Anzahl von Profilaufrufen, Anfragen, Buchungen, Vermittlungen oder wirtschaftlichen Erfolg.

6a. Gold · Performancelab, Wettkampf- und Trainingsplanung

Die Gold-Abonnement kann ein nicht öffentliches Performancelab zur Verwaltung von Personen, Gruppen, Wettkämpfen, geplanten Starts, Benchmarks, Schwimm- und Athletiktests, Testbatterien, Testterminen, Körper- und Leistungsbasiswerten, gruppen- und disziplinbezogenen Performance-Monitoren, trainerdefinierten datierten persönlichen Zielkorridoren für Wettkampf- und Athletikleistungen sowie Gruppenzielkorridoren sowie zugehörigen Notizen enthalten. Welche Funktionen im Einzelnen verfügbar sind, ergibt sich aus der jeweils aktuellen Leistungsbeschreibung der Gold-Abonnement.

Gold also includes a structured training-planning workspace with seasons, macro-, meso- and microcycles, training sessions, sets and intervals; authorised athlete assignments; planned-versus-actual analysis of training volume, strokes and intensity; and exportable annual, weekly, session and statistics PDFs. Illustrative Jonas sample training records are fictional, stored separately for each authorised trainer and may be edited, hidden or deleted. The coach is responsible for training methods, input data and decisions. These features do not grant public access to private training records.

Reports & PDF export: Gold members can generate individually assembled athlete and group reports from data stored in the Performancelab and download them as PDF files. Export requires authentication and the appropriate access entitlement. The user is responsible for selecting content and lawfully sharing reports with recipients; the reports may contain particularly sensitive data and are not a medical diagnosis or a substitute for professional assessment. Generated reports are not stored as separate permanent files in the platform account.

The Performancelab is an organisational, documentation and analysis tool for training and sport. Reference ranges, dynamic benchmark corridors, performance indices, internal orientation values, side-to-side asymmetries, derived strength ratios, coach-defined target corridors and summary battery displays are training and comparison aids. Personal target corridors are training goals set by the user and do not replace objective or platform-based reference models. They do not constitute a medical diagnosis, treatment, medical clearance for performance or any guarantee of a sporting result.

Anyone entering data of other persons, in particular athletes, into the Performancelab remains responsible for ensuring that collection, entry and further use of those data is lawful. This applies especially to data of minors and to performance-diagnostic, body-related or other data that may qualify as health data or other specially protected personal data. Users may process such data only where a valid legal basis exists and, where required, an exception under Article 9(2) GDPR applies.

Where a user determines the purposes and means of processing data of other persons, for example as a coach, club, federation, swimming school or other organisation, that user is generally the controller responsible for that processing under data protection law. schwimmtrainer.at then processes data stored in the Performancelab as part of platform provision and on the user’s instructions. In that situation, the following additionally apply: Data Processing Terms as part of the user agreement.

Planned competitions, test batteries and test sessions are intended for work organisation. Test batteries can be assembled as reusable templates and distributed across several sessions; individual sessions can be assigned to multiple athletes. Dates, target times, target placings, test assignments and other planning targets can be changed or deleted by the user. A planned competition date is not a commitment by the organiser and does not replace an official entry, registration or eligibility to start.

Form drafts in the Performancelab may be automatically cached on the server so that entries already started can be restored after interruptions. A draft is not yet a completed test, competition or result record; such a record is created only by the respective save action.

6b. Editorial premium downloads and digital content

In the “Knowledge → Downloads & templates” section, schwimmtrainer.at may provide its own editorial files and digital content, such as templates, worksheets, contract and organisational templates, calculation and billing files, presentations, images, archives, audio files or videos. This editorial library is distinct from the resources that Gold profiles may offer in their public profile.

Jeder redaktionelle Download kann einer Mindest-Abonnementstufe Bronze, Silver or Gold zugeordnet werden. Zugriff besteht nur während einer aktiven Abonnement, die mindestens dieser Stufe entspricht. Silber umfasst dabei die für Bronze freigegebenen Downloads; Gold umfasst die für Bronze und Silber freigegebenen Downloads. Zeitlich befristete Geschenkfreischaltungen werden für die Dauer ihrer Freischaltung entsprechend ihrer Stufe behandelt.

Die Dateien werden über einen geschützten Download-Endpunkt ausgeliefert. Ein einmal rechtmäßig heruntergeladenes Exemplar kann technisch auf dem Endgerät des Nutzers verbleiben; ein fortdauernder Plattformzugang nach Ende oder Herabstufung der Abonnement ist damit nicht verbunden.

Unless otherwise stated for an individual download, the user receives a non-exclusive, non-transferable right to use the file for their own or internal purposes within its apparent intended use. Paid resale, systematic redistribution, public provision or removal of rights and source notices is not permitted without appropriate authorisation. Different licence notices or third-party rights relating to specific material take precedence over this rule.

Contract templates, invoices, calculations and other templates are general working aids and do not constitute individual legal, tax, accounting or business advice. Before specific use, suitability for the individual case and the current legal position must be checked. Mandatory statutory warranty and consumer rights, in particular under the Austrian Consumer Warranty Act (VGG) for digital services, remain unaffected.

Die Premium-Downloads werden nicht als einzelne Dateien separat verkauft, sondern als Bestandteil der jeweiligen laufenden Premium-Abonnement bereitgestellt. Soweit einzelne Bestandteile rechtlich als digitale Inhalte im Sinn des FAGG bzw. VGG einzuordnen sind, gelten die hierfür zwingenden gesetzlichen Bestimmungen. Aus dem bloßen Abruf einer Datei wird kein darüber hinausgehender Verzicht auf gesetzliche Rücktrittsrechte abgeleitet.

Gold access and demonstration records

Performancelab is a private performance-management service within the Gold membership. While the membership is active, the account holder receives a personal, non-transferable and non-sublicensable right to use the provided functions for lawful coaching and athlete management. Authorised athlete and guardian portals are governed by their respective invitation and read-only permissions; they do not provide a transferable Gold licence.

Gold members may use a private demonstration group containing three fictitious athletes with sample competition results, swimming and strength tests, reference benchmarks and personal target ranges. These demonstration records are editable and may be deleted. At the member's explicit request, authorised support staff may restore them within that member's account; such a request does not authorise access to unrelated private athlete data.

7. Geschenkfreischaltungen

schwimmtrainer.at may grant individual persons or organisations a Bronze-, Silber- oder Gold-Abonnement für einen bestimmten Zeitraum unentgeltlich freischalten („Geschenkfreischaltung“). Die Freischaltung ist an die dafür hinterlegte Empfänger-E-Mail-Adresse gebunden.

Besteht für diese E-Mail-Adresse noch kein Benutzerkonto, wird durch die Vergabe der Geschenkfreischaltung not automatically create a user account. During its validity period, the activation can be assigned to an account by voluntarily registering with exactly that email address. If no registration takes place, no payment obligation or paid subscription arises.

Eine Geschenkfreischaltung erzeugt no invoice, no Stripe payment and no automatic renewal. It ends automatically at the stated end time. It is non-transferable and cannot be redeemed or paid out in cash.

Ein bereits bestehendes oder später abgeschlossenes reguläres kostenpflichtiges Abo wird durch eine Geschenkfreischaltung weder gekündigt noch pausiert oder in seiner Laufzeit verändert. Während des Geschenkzeitraums gilt für die Plattformfunktionen jeweils die höherwertige verfügbare Abonnement. Nach Ablauf der Geschenkfreischaltung gilt automatisch wieder das reguläre Abo oder – sofern keines besteht – Standard.

schwimmtrainer.at kann eine Geschenkfreischaltung aus sachlichem Grund vorzeitig beenden, insbesondere bei Fehlvergabe, Missbrauch, Verstößen gegen diese Nutzungsbedingungen, Löschung des Benutzerkontos oder einer erforderlichen technischen bzw. administrativen Korrektur. Bereits erworbene Rechte aus einem kostenpflichtigen Abo bleiben davon unberührt. Empfänger können jederzeit verlangen, dass eine Geschenkfreischaltung nicht genutzt bzw. deaktiviert wird. Zwingende gesetzliche Rechte bleiben unberührt.

8. Vertragsschluss bei kostenpflichtigen Abonnements

Vor dem kostenpflichtigen Abschluss werden Abonnement, Abrechnungsintervall, Preis, Laufzeit- und Kündigungsinformationen sowie die maßgeblichen Rechtstexte angezeigt. Die Zahlung wird über Stripe Checkout abgewickelt. Der kostenpflichtige Vertrag kommt zustande, wenn der Nutzer den Bezahlvorgang bei Stripe zahlungspflichtig abschließt und Stripe die Bestellung bestätigt.

For a personal profile requiring evidence, submitted qualification evidence is a prerequisite for starting paid checkout at all. If review is still pending at that time, the contract is concluded subject to the quality and refund mechanism described in Section 4; the public profile remains blocked until review is successful.

After successful completion, the user receives a contract confirmation at the stored email address. The confirmation contains the essential contract data and references to the Terms and Conditions and withdrawal rights.

9. Prices and payment

The prices in euros displayed immediately before purchase apply. For consumers, the total price shown during the order process is the amount payable. Any taxes required by law are handled in accordance with the applicable statutory rules and shown during payment.

Payment is processed through Stripe. schwimmtrainer.at does not store complete credit-card or other payment data. The payment methods actually available are shown in Stripe Checkout.

10. Term, renewal, cancellation and account deletion

Monatliche Abonnements laufen jeweils für einen Monat, jährliche Abonnements jeweils für ein Jahr. Sie verlängern sich automatisch um den jeweiligen Abrechnungszeitraum, sofern sie nicht vor Ablauf des laufenden Zeitraums gekündigt werden.

Die reguläre Kündigung ist über „Mein Konto“ und das dort verlinkte Stripe-Kundenportal möglich. Eine solche Kündigung wirkt grundsätzlich zum Ende des bereits bezahlten Abrechnungszeitraums. Bis dahin bleibt die gebuchte Premiumstufe nutzbar. Danach fällt das Konto automatisch auf die kostenlose Standard-Zugang zurück, sofern es nicht gelöscht wird.

Wird dagegen das gesamte Benutzerkonto über die Löschfunktion entfernt, wird ein noch aktives kostenpflichtiges Abonnement vor der Kontolöschung sofort beendet, damit keine weitere Verlängerung oder Folgebelastung erfolgt. Die freiwillige Kontolöschung allein begründet keine zusätzliche automatische Rückerstattung eines bereits bezahlten und bereitgestellten Abonnementszeitraums. Gesetzliche Ansprüche, insbesondere ein wirksam ausgeübtes Rücktrittsrecht, sowie die besondere Rückerstattungszusage bei negativer Qualifikationsprüfung nach Abschnitt 4 bleiben unberührt.

11. Consumer right of withdrawal

Consumers generally have a statutory right of withdrawal for distance contracts. Details and the model withdrawal form are available under Withdrawal shown there.

If a consumer wishes the digital service to begin before the statutory withdrawal period expires, an express request is obtained before payment. If withdrawal is exercised after performance has begun, a proportionate amount for the service supplied up to withdrawal may be payable to the extent provided by law.

A gift membership provided free of charge creates no payment obligation and no Stripe subscription. A recipient who does not wish to use the gift membership may request its deactivation at any time by emailing office@schwimmtrainer.at. Mandatory statutory rights of withdrawal and consumer-protection rights remain unaffected.

12. Availability and technical changes

schwimmtrainer.at endeavours to provide high availability but does not guarantee uninterrupted or error-free accessibility. Maintenance, security measures, outages at hosting, payment or network service providers and technical developments may temporarily restrict availability.

Functions may be further developed or technically adapted provided the essential nature of the booked service is preserved and users are not unreasonably disadvantaged. Material adverse changes to ongoing paid contracts will be made only within the scope permitted by law.

Support tickets and controlled account assistance

Members can send support tickets through the platform. The ticket itself does not authorise access to confidential athlete records. Any assistance requiring access to protected account content must be separately authorised by the member for a specified scope and limited period; authorisation can be withdrawn. Support access and relevant changes are logged. Passwords, authenticator secrets and recovery codes must not be included in tickets. Support is provided within reasonable operational capabilities; no individual response time or guaranteed availability is promised unless expressly agreed.

13. Moderation, suspension, administrative deletion and rule violations

schwimmtrainer.at may hide or remove content and temporarily suspend accounts where there are specific indications of a breach of these terms, third-party rights, legal requirements or platform security. Where appropriate, users will be given an opportunity to comment or correct the issue.

A profile and user account may also be deleted by the operator if requested by the account holder, if a duplicate or mistakenly created profile needs to be cleaned up, or if a serious or repeated rule violation makes continuation of the contractual relationship unreasonable. The operator documents the reason for deletion. Unless prevented by security, misuse or legal considerations, the user will be informed about the deletion and the reason.

Where a restriction, suspension or deletion is based on information supplied by the user being unlawful or breaching these Terms of Use, the affected user will, where the legal requirements are met and electronic contact details are known, receive a clear and specific statement of reasons. The notice should include, in particular, the relevant facts or circumstances, the applicable rule violation, the nature of the measure and a means of submitting comments or requesting review. Decisions on administrative profile deletions for rule violations are not taken exclusively by automated means.

In the event of administrative deletion, any active paid subscription is terminated so that no further automatic renewal occurs. Deletion due to a rule violation does not in itself create an additional contractual claim to a refund for services already properly supplied or made available. Any refunds for periods not yet supplied are governed by mandatory statutory requirements and the circumstances of the individual case. The refund expressly promised in Section 4 for a negative qualification review remains unaffected.

In cases of serious misuse, attempted manipulation, false identity or qualification information, attacks on the platform or other legal infringements, further claims and legally required measures remain reserved.

14. Specialist content and sport-science information

Specialist articles, training information, editorial premium downloads, templates, evaluations and other content are provided for general information and do not replace medical diagnosis, treatment or individual medical advice. Qualified medical professionals should be consulted in cases of health complaints or uncertainty.

Coaching and sport-science content must be applied in the relevant context. Users remain responsible for their specific training and safety decisions.

15. Rights in platform content

Original platform software, source code, visual interface designs, product artwork, training and editorial materials, graphics and other qualifying works are protected by applicable law. Membership permits only the agreed use of the respective features; it does not convey copyright, source-code ownership or a right to sublicense the service.

Systematic extraction, unauthorised reproduction, publication, redistribution, resale, commercial copying or reconstruction of protected software, concrete interface designs, protected workflow representations, reports, texts or graphics requires prior written permission, unless a statutory permission applies. The mere idea behind a workflow, abstract method or functional principle is not automatically copyright-protected; neither does this clause restrict legally permitted independent development, quotation, interoperability or users’ ownership and rights in their own data.

16. Warranty and liability

The statutory warranty provisions apply. Statutory liability rights of consumers are not restricted.

In relation to business customers, schwimmtrainer.at is liable for slight negligence, to the extent permitted by law, only for breach of material contractual obligations and only for damage that is typically foreseeable. Liability for personal injury, intent, gross negligence and mandatory statutory liability remains unaffected.

Registered users are generally responsible for their own information, offers and services. schwimmtrainer.at gives no guarantee as to their accuracy, quality, availability or suitability.

17. Data protection

Information on the processing of personal data is provided in the Privacy Notice.

18. Changes to these terms

For new contracts, the version made available when the contract is concluded applies. Changes to ongoing contracts are made only where legally permissible and objectively justified. Where consent is required, it will be obtained expressly.

19. Applicable law, jurisdiction and dispute resolution

Austrian law applies, excluding conflict-of-law rules. For consumers, this choice of law applies only to the extent that it does not deprive them of mandatory protection afforded by the law of the state of their habitual residence.

For business customers, Vienna is agreed as the place of jurisdiction to the extent permitted by law. Statutory places of jurisdiction apply to consumers; in particular, mandatory consumer jurisdictions are not restricted by these terms.

The designation stated in the legal notice Company register court: Commercial Court of Vienna refers exclusively to the court responsible for the company-register entry. By itself, it does not establish an exclusive jurisdiction for disputes with customers.

The operator has not currently submitted generally to any alternative dispute resolution body. If no agreement can be reached with a consumer in a dispute arising from a paid contract, the consumer will be informed, in accordance with Section 19(3) AStG, on paper or another durable medium, about the ADR body or bodies competent for the specific dispute and whether the operator will participate in proceedings. The former EU Online Dispute Resolution platform was discontinued on 20 July 2025.

20. Online shop: offer, order, contract formation and payment

The presentation of goods and digital content in the online shop is an invitation to place an order. An order can be placed as a guest without signing in to the portal als auch über ein bestehendes Konto möglich. Optional kann beim Gast-Checkout die Anlage eines kostenlosen Kundenkontos für die spätere Bestellübersicht gewählt werden; das Konto wird nach erfolgreicher Zahlung angelegt. Eine Plattform-Abonnement ist dafür nicht erforderlich. Unmittelbar vor der Bestellung werden die wesentlichen Eigenschaften der ausgewählten Produkte, Mengen, Einzel- bzw. Gesamtpreise, Versandkosten und der Gesamtbetrag hervorgehoben dargestellt. Mit der Schaltfläche “Place order with obligation to pay” the customer submits a binding order with an obligation to pay and is then redirected to Stripe for payment processing.

The contract takes effect at the latest when payment has been successfully confirmed and the order accepted. If payment events are technically inconsistent or contradictory, the order may be held for manual review. A charge without the corresponding Stripe payment confirmation does not trigger automatic fulfilment.

Payment is processed through Stripe. schwimmtrainer.at does not store full card or bank details. The total price in euros shown at checkout, including any stated shipping costs, is the amount payable.

21. Goods, delivery and shipping

Physical goods are currently shipped exclusively within Austria. The shipping method shown at checkout and the shipping costs stated there form part of the order. Unless otherwise stated for the product, the estimated delivery time is 2–7 Werktage nach bestätigtem Zahlungseingang, sofern beim Produkt nichts Abweichendes angegeben ist. Mandatory statutory delivery periods and rights in the event of delayed delivery remain unaffected.

Where a more environmentally friendly delivery option can actually be offered, it will be identified as such during the order process. If no such option is available, no special environmentally friendly delivery method is promised.

When exercising the statutory right of withdrawal, the consumer bears the direct costs of returning the goods unless otherwise promised in the specific order process or order confirmation. Details are set out in the Right of withdrawal.

22. Statutory warranty, durability guarantees and product information

Mandatory statutory warranty rights apply to goods. From the legally relevant date, the harmonised EU notice on statutory warranty rights will be displayed in the online shop. A voluntary manufacturer guarantee exists only if expressly stated for the specific product; it does not restrict statutory warranty rights.

If the manufacturer offers a commercial guarantee of durability free of charge for the entire product for more than two years, and the operator has the information required to display it, the duration and the required harmonised GARAN label are shown with the product and again at checkout.

Manufacturer or economic-operator details, safety and care instructions, and any other mandatory information are provided on the product page where required and available for the specific product. Digital services are subject to the applicable statutory conformity and warranty rights.

23. Individual digital content and immediate download

Digital content sold individually through the online shop is made available after payment has been confirmed via a protected, order-specific download. Where a customer account exists, the order also appears in the customer’s personal order history. Unless the product states otherwise, the customer receives a non-exclusive, non-transferable licence for personal or internal use. Resale, systematic redistribution or public availability is not permitted without the appropriate authorisation.

If paid digital content is to be supplied before the statutory withdrawal period has expired, checkout separately obtains the consumer’s express consent to performance beginning early and acknowledgement that, where the statutory conditions are met, this results in the loss of the right of withdrawal. These declarations are recorded in the post-contractual order and contract confirmation provided on a durable medium. An immediate download is not enabled under this mechanism unless the required declarations have been obtained.

24. Order and contract confirmation

After confirmed payment, an order and contract confirmation is sent to the email address provided at checkout or stored in the account for signed-in customers. It includes, in particular, the ordered items, prices, shipping costs, total price, the versions of the contractual and withdrawal information stored for the order and, for digital content made available immediately, the documented declarations regarding early commencement of performance. The operator also receives an internal order summary.

For paid shop orders, an electronic invoice with a unique invoice number is provided. Customers with a customer account can permanently access it as a PDF in the order overview; for guest orders it is available through the protected order view. Sandbox/test orders are expressly marked as test invoices with no real payment.

25. Withdrawal from shop orders

Consumers have the statutory right of withdrawal in accordance with the Austrian Distance and Off-Premises Contracts Act (FAGG). Different rules govern when the withdrawal period begins for goods, services and digital content. Full information and the model withdrawal form are available under Withdrawal available there.

In addition, the readily accessible Online withdrawal form is available without sign-in. It can also be used to declare a partial withdrawal by specifying the affected items or positions.

Athlete and guardian PDF export

An athlete with a currently valid personal viewing permission, or an authorised adult legal guardian with a currently valid guardian permission, may download a custom report using the same Gold · Performancelab PDF format as the coach. The report includes only the individual records shared through that permission and the specifically selected categories and period; no group, other-athlete, private coach notes or editable coach data are included. Private athlete-defined motivation targets, where available, are identified separately and cannot overwrite coach plans. Downloading does not confer new editing or disclosure rights. Sharing sensitive data with third parties requires an appropriate legal basis and authorisation. Reports are not retained as separate permanent PDF files on the platform.
