General information on the right of withdrawal for consumers

Abonnements / digitale Dienstleistungen

For Bronze, Silver and Gold, the 14-day period generally begins on the day the contract is concluded. If performance begins before expiry of that period at the consumer’s express request and the contract is subsequently validly withdrawn, a proportionate amount may be payable for services already supplied to the extent provided by law. The statutory requirements for any loss of the right of withdrawal remain unaffected.

Goods from the online shop

For a sales contract for goods, the withdrawal period generally begins on the day on which the consumer or a third party designated by the consumer, other than the carrier, takes possession of the goods. Special statutory rules apply to the start of the period for multiple goods, partial deliveries or regularly delivered goods.

After an effective withdrawal, goods received must be returned without undue delay and no later than 14 days after the notice of withdrawal is made. The consumer bears the direct cost of returning the goods unless otherwise promised in the specific order process or order confirmation. The consumer is liable for any diminished value only where it results from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Payments received will be reimbursed in accordance with the statutory provisions. In the case of goods, reimbursement may be withheld, where permitted by law, until the goods have been received or evidence of their return has been provided.

Individually sold digital content / downloads

Paid digital content not supplied on a tangible medium is generally also subject to a 14-day right of withdrawal. If the download is to be provided immediately, before that period expires, schwimmtrainer.at separately asks at checkout for express consent to begin performance early and confirmation that the consumer understands that, under the statutory conditions, this causes the right of withdrawal to be lost.

The right of withdrawal is lost in relation to an immediate download only where the statutory requirements are met. The relevant declarations are documented in the post-contractual order and contract confirmation provided on a durable medium.

Online withdrawal form

Under Withdraw from contract kann eine online geschlossene Abonnement oder Shopbestellung ohne Anmeldung elektronisch widerrufen werden. Das Formular ermöglicht auch die Angabe einzelner Artikel/Positionen für einen Teilwiderruf. Nach dem Absenden über „Widerruf bestätigen“ wird der Inhalt der Erklärung samt Eingangsdatum und -uhrzeit unverzüglich an die angegebene E-Mail-Adresse bestätigt.

The online form is an additional way to exercise the right of withdrawal. Withdrawal can still be declared by any other legally permitted means using an unequivocal statement, in particular by email.

Qualification review and additional contractual refund

If a Bronze, Silver or Gold subscription entered into after qualification evidence was submitted is later terminated because that evidence cannot be accepted for the selected personal profile type, the additional contractual refund undertaking described in the Terms and Conditions also applies. It does not limit or replace the statutory right of withdrawal.

Eine unentgeltlich vergebene Geschenkfreischaltung löst keine Zahlung, keine Rechnung und kein Stripe-Abonnement aus und verlängert sich nicht automatisch. Wer eine Geschenkfreischaltung nicht nutzen möchte, kann ihre Deaktivierung jederzeit per E-Mail verlangen.
